Frequently asked questions

  • What is commercial property law?

Commercial property law covers the transfer, use and management of land for commercial purposes. This includes things like commercial leasing and property development, as well as sales and purchases.

  • What do commercial property lawyers do?

Commercial property lawyers are specialists in legislation covering commercial property.  You might consider engaging a commercial property lawyer if:

    • You want to buy or sell commercial land.
    • You're planning a commercial development.
    • You're renting a commercial property and have a dispute with your landlord.
    • You're a commercial landlord and you have a dispute with a tenant.
    • You're planning to purchase or develop a commercial property next to residential properties, and you need to know what you're allowed to do.
    • You need advice on any aspect of commercial property law.
  • What is commercial conveyancing?

Much like its residential equivalent, commercial conveyancing is the legal process of transferring ownership of a property – usually because the property has been sold. However, commercial conveyancing is strictly concerned with the transfer of commercial properties.

Commercial conveyancing is a complex process that's usually carried out by a trained conveyancing solicitor or a licensed conveyancer.

  • What does commercial power of attorney mean?

A business lasting power of attorney (business LPA) is a document that allows an appointed person (your attorney) to make business-related decisions if you're unable to do so.

Your business LPA could come into effect if:

    • You can't be physically present – e.g. if you're in another country and are unable to travel back to the UK.
    • You lose the mental capacity to make decisions or give directions in business-related matters, following a medical diagnosis or accident.

Nobody wants to imagine a scenario where they can't make decisions for themselves. But making a business LPA means planning for the worst. You'll know that, should the unthinkable happen, your commercial interests will be protected.

It's possible to make more than one LPA, appointing different attorneys to deal with business and personal matters. However, it's important to give careful instructions regarding the scope of each attorney's powers. Our commercial law experts can help make sure the documents are clear and unambiguous.
